从国际法视角看西方对叙利亚的干涉 刘军华 【期刊名称】《南京财经大学学报》 【年(卷),期】2012(000)004 【摘 要】叙利亚的局势关系到世界的和平与稳定，涉及许多重大国际法问题。以美国为首的西方企图把利比亚干涉模式复制到叙利亚，强行推动叙利亚政权更迭，影响叙利亚问题的和平解决。西方强行推动叙利亚政权更迭是对叙利亚内政的粗暴干涉，违反国际法不干涉内政原则，不经安理会授权的军事干涉是违反不侵犯原则的侵略行动。中国在叙利亚问题上的立场和做法是对国际法律秩序的维护。叙利亚的问题应排除西方干涉，由双方和平解决，若局势恶化应由安理会解决。%The situation in Syria is related to peace and stability in the world, involving a number of major questions of in- ternational law. Western countries leaded by the United States want to copy interference pattern of Libya to Syria, which affects seriously the peace solution on this matter. Legitimacy and substance analysis of this model is a prerequisite for properly deal with Syria as well as future similar events. Western countries force a change of Syrian government, it is interference in internal affairs of Syria, and violates the principle of non-interference in internal affairs. Military intervention without authorization of the Security Council is an aggression act violating the principle of non-invasion principle. China's position and practices are the maintenance of international legal order. Syrian problems should solve peacefully by both parties , excluded from the interference of Western countries.
