违反夫妻忠实义务的精神损害赔偿规则研究 违反夫妻忠实义务的精神损害赔偿规则研究 摘要 我国的《婚姻法》中明确规定我国实行的是一夫一妻制，夫妻之间不仅负有相互扶养的义务，而且也承担着忠实的义务。随着社会的不断发展，越来越多的“第三者”介入到婚姻家庭关系中，破坏家庭和谐，导致婚姻破裂的情况越来越多。在婚姻关系中处于出轨一方对无过错方造成的损害，无过错方是否能够提起精神损害赔偿，司法界存在一定的分歧，婚姻关系的过错方由于出轨行为导致婚姻关系破裂的，虽然我国的《婚姻法》中明确规定存在过错方应当少分夫妻共同财产，适当对无过错方进行赔偿，但是这一规定无法满足当前司法实践的需求，而且对于婚姻无过错方来说，这种规定难以抚平其精神上受到的伤害。夫妻之间存在忠实义务，本文通过以违反夫妻忠实义务的精神损害赔偿规则为研究对象，分析当前违反夫妻忠实义务的类型，并剖析违反夫妻忠实义务的精神损害赔偿请求的依据、范围以及原则，从而提出具体的完善对策，为我国婚姻家庭法律体系的完善提供借鉴。 关键词：夫妻忠实义务，婚姻法，精神损害赔偿，请求权 Abstract China's "Marriage Law" clearly stipulates that China is the implementation of monogamy, between husband and wife not only have the obligation to support each other, but also bear a loyal obligation.
